PASTOR SUNDAY SUES THE MINISTRY OF INTERNAL AFFAIRS

As it is known, the Ministry of Internal Affairs initiated a criminal case against pastor Sunday Adelaja in connection with the collapse of the "Kings Capital" Company. However, even though more than nine months have already passed, the case still has not gone to trial.  

Pastor Sunday has repeatedly stated and continues to uphold his position that if law enforcement agencies or anyone else accuse him and are persuaded of his guilt, let them refer the case to court. In his turn, Pastor Sunday is awaiting the trial in order to justify and defend himself. During these 9 months the Ministry of Internal Affairs failed to find enough documents to prove the guilt of Pastor Sunday. However, the police have released the main accused, the head of the collapsed company "Kings Capital" Alexandr Bandurchenko, who immediately began to give interviews saying that he was not involved into the affair, and Pastor Sunday knows where the money is.

In regard to this, Pastor Sunday and his lawyer Andrei Fedur decided to no longer wait for more accusations and not to tolerate such abuse from the Mass Media, but to appeal against the decision to institute a criminal case against pastor Sunday. The hearing on the case began in the beginning of September. Since then, five (5) hearings have been held in the court, however every time the court had to postpone the hearing for one reason - the Ministry of Internal Affairs could not provide any documents to the prosecutor to accuse pastor Sunday. 

The next hearing is scheduled for September, the 30^th . Let’s hope that till that time the Ministry of Internal Affairs will be able to collect the sufficient number of documents in order to hold the court. According to the Criminal Code of Ukraine, I quote, «legal proceedings can be instituted only in such cases, which constitute sufficient data to show the availability of signs of crime".

Pastor Sunday continues to assert the fact he has repeatedly been saying all this time: "I do not have any relation neither to activities (creation), nor to the management, nor to the finances of the Kings Capital Company. And we intend to prove it in court."
 
According to the recent reports of Mr. Lutsenko, it is clear they have no chance to win the case, and they have exhausted all their possibilities. Mr. Lutsenko himself intends to apply to the Security Service of Ukraine for help in investigating the criminal case against the Pastor of the Embassy of God church Sunday Adelaja, but this time for another reason. In the initiation it is noted: "in his sermons S. Adelaja points that the main task of the religious organization led by him is creation of so-called "Christian government" on the territory of Ukraine, thus he ignores the obvious fact of Ukrainian statehood”. http://politinform.org/node/3087. 

Therewith, according to the previous assessment of the central investigation department of the security service of Ukraine, there are no grounds for criminal prosecution according to the article 110 of the Criminal Code of Ukraine. Despite the attempts of the Ministry of Internal Affairs to persuade the Security Service to undertake the case of the pastor, they refused to do it, because there is no reason for that.

It is also known that in this context, the First Vice Prime Minister of Ukraine Turchinov A. charged the Deputy Minister of the Cabinet of Ministers of Ukraine S. Chebotar to organize a closed meeting on this subject involving the heads of the Foreign Ministry, Security Service, Ministry of Internal Affairs, General Prosecutor’s Office, Ministry of Justice and the State Committee for Nationalities and Religion.

It means that Pastor Sunday was right when he affirmed the true reason for a criminal case was not fraud, but political reprisal, and they are not interested in the fate of the investors. Moreover, a party mate of Lutsenko - Mr. Kulikov – openly stated:  “Any article can be fasten on Sunday”. Also, MIA calls the parishioners of the church, who were at least somehow close to surroundings of pastor Sunday, pressures and intimidates them in order to wrest a testimony against pastor Sunday from them, otherwise they threaten them with a reprisal. 

If Ukrainian power bodies are involved in the reprisal over the pastor, then what kind of a constitutional state do we live in? Is this the democracy we have been fighting for?
